As you know, your display of these photos specifically violates Ms. Fuentes’s rights of privacy and publicity under California common law and California Civil Code sections 3344 and 1708.8, among other provisions. By displaying these unauthorized photographs on your site, you could be held liable for, among other things, triple the amount of actual damages plus punitive damages, which in this case could amount to millions of dollars. Needless to say, your display of these unauthorized photographs is extremely damaging, upsetting and distressing and would also warrant entry of a Temporary Restraining Order or Preliminary Injunction to have them removed. If forced to bring suit, Ms. Fuentes also would be entitled to recover her legal fees.
If you remove the photos immediately and take no further action to disseminate them (or encourage others to do so), we have been instructed to take no further action against you. If you do not remove these unauthorized photos, however, we will take all necessary and appropriate measures to protect our client’s rights.
